Two San Jose police officers charged with evidence tampering and false report
The department says one officer replaced missing drug evidence with a baggie seized in an unrelated stop. Both are on paid leave.
SAN JOSE — Two San Jose police officers were charged Oct. 28 with felony evidence tampering and filing a false police report, according to a San Jose Police Department news release issued Oct. 29. Both were booked into the county jail that night.
The officers are a 29-year-old man and a 30-year-old woman, both Gilroy residents, with eight and six years on the force, the release said.
Police say the case began in August, when the male officer learned that a small baggie of suspected drugs listed in his report on a May 3 arrest had never been booked into evidence. On Aug. 12, the release says, he seized a similar baggie during an unrelated stop, took no other action and booked it under the May case number. The female officer, who is in a relationship with him, is accused of viewing body-camera video of the May arrest to help plan the swap.
Both were placed on paid leave in September. A review of their cases is still under way and so far has found no other problems, the department said. The District Attorney's Office filed the charges against both officers.
"Falsifying evidence or police reports is a crime," Police Chief Paul Joseph said in the release.
