San Jose to pay $400,000 to settle suit over police car hitting pedestrian
The council votes Nov. 3 on the settlement of a 2023 crosswalk crash at East San Antonio Avenue.
SAN JOSE - The San Jose City Council is asked Nov. 3 to approve paying $400,000 to settle a lawsuit over a police car that struck a pedestrian in 2023, according to a memo from City Attorney Susana Alcala Wood.
The suit says an on-duty officer turning left hit a man walking in a marked crosswalk with a walk signal on June 27, 2023, at East San Antonio Avenue and Scharff Avenue. He claimed broken facial bones and teeth, five broken ribs and a broken left wrist. His wife claimed loss of consortium, a legal term for harm to a marriage from a spouse's injury. These are claims in the suit, not court findings.
Each side pays its own legal fees. The money comes from the city's general liability claims fund, which has $12.1 million budgeted this year. The item is on the consent calendar, routine items passed in one vote unless pulled.
