Valley Water board votes today on $125.6 million Coyote Creek flood walls contract

Staff want to skip a new round of bids and hire the second-lowest bidder after the first contractor's deal ended.

SAN JOSE - The Valley Water board votes Tuesday, Oct. 27, on a $125,649,597 contract to build flood walls along Coyote Creek, according to a district staff memo. Staff recommend Gordon N. Ball Inc. of Alamo, plus up to $18,847,440 for changes during construction.

The board first gave the job to Shimmick Construction Co. in July. The memo says the two sides agreed to end that contract but gives no reason. Gordon N. Ball, the second-lowest bidder, agreed to keep its price.

Staff ask the board to skip new bidding, calling it "competitively unavailing," a legal term for bidding that would bring no benefit. Rebidding would delay work at least three months, they say.

The project covers about 9 miles of the creek in San Jose, between Montague Expressway and Tully Road. Work would run from November 2026 to October 2028.

The board will also decide whether an El Niño emergency, declared Oct. 7, still exists, which takes a four-fifths vote, and hold a hearing on continuing the censure of Director Rebecca Eisenberg. The public session starts at 1 p.m. at 5700 Almaden Expressway and on Zoom.
