San Jose council to vote Nov. 3 on keeping pause on new detention centers until 2028

Extending the moratorium takes a four-fifths vote, at least nine of the 11 council members.

SAN JOSE - The San Jose City Council will vote Nov. 3 on extending a pause on new detention and custodial facilities for 14 more months, according to a city staff memo. The pause, called a moratorium, would run through Jan. 13, 2028.

The council adopted the 45-day moratorium Sept. 29. It blocks applications to build, expand or convert a site into a detention facility on private or public property, as far as state and federal law allow. It ends Nov. 13 unless extended.

State law requires a four-fifths vote to extend it. On the 11-member council, that means at least nine votes. The extension would take effect right away.

Staff say they need the time to study the effects of such facilities and write permanent zoning rules. They would report back by Jan. 3, 2028. The original request cited a proposed federal facility on Holsclaw Road near Gilroy.

The council meets at 1:30 p.m. Nov. 3, Election Day.
